Principal Attorney Elizabeth A. Tresp specializes in estate planning and trust and estate administration, with extensive experience litigating trust and estate disputes, including complex trust matters, the real-world experience that separates a plan built to hold from one built to sell. She is admitted in California, Wyoming, and Montana, and before the United States Tax Court and the United States District Courts for the Southern and Eastern Districts of California.
She is a nationally recognized speaker in finance and investor circles. She appears on podcasts and at conferences across the country with voices her clients already know, including Peter Schiff, Ken McElroy, Dana Samuelson, Steve Streetman, Mike Maloney, Scott Saunders, and Robert Kiyosaki. The plan she describes on a stage is the same plan she will defend in court.
Elizabeth isn’t only an attorney, she’s a business owner and real-estate investor who understands her clients because she lives the same life, with commercial and residential holdings and ownership interests across multiple companies. What is asset protection and who needs it?
Asset protection is legal planning that places your wealth beyond the easy reach of future creditors and lawsuits. Anyone with assets to protect can benefit, business owners, physicians, real estate investors, and families, because insurance alone has limits. It works best when set up in calm legal waters, before a claim arises.
What is the difference between domestic and offshore asset protection?
A domestic asset protection trust (DAPT) is formed under a favorable U.S. state’s law; an offshore asset protection trust (OAPT), such as a Cook Islands trust, is formed in a foreign jurisdiction with strong debtor-protection statutes. Offshore structures generally offer the strongest protection and privacy, while domestic ones are simpler and less costly. We advise on both.
When should I set up asset protection?
Before you need it. Asset protection is most effective when implemented preemptively, in calm legal waters. Transferring assets after a lawsuit is threatened or filed can be challenged as a fraudulent transfer, so the time to plan is now, while no claims are pending.
