How Texas protects, and its limits

The homestead is powerful, and it isn’t everything
Texas’s constitutional homestead is one of the country’s strongest: it caps the protected homestead by acreage rather than value, so a modest home and a multi-million-dollar one receive the same shelter from most creditors. (In bankruptcy, a federal cap can apply to equity acquired shortly before filing.) But the homestead protects your residence, not your rental portfolio, your brokerage account, or your business. Those require structure.
Where structure fills the gap
Because Texas offers no self-settled asset-protection trust, a Texan who wants to protect non-exempt assets typically pairs Texas exemptions with entities, LLCs (including the Texas series LLC) to hold investment property and business interests, and, for stronger protection, a trust established in a dedicated DAPT jurisdiction such as Nevada or Wyoming, or an offshore structure. The result keeps the benefit of Texas’s exemptions while covering what they leave exposed.

Does Texas allow asset protection trusts?
Not self-settled ones. Texas is not a domestic-asset-protection-trust (DAPT) state, so you cannot place your own assets in a Texas trust for your own benefit and shield them from your future creditors. Texas protects wealth through exemptions, notably its unlimited-value homestead, and through entity structuring. For self-settled trust protection, Texans typically use a DAPT state like Nevada or Wyoming, or an offshore structure.
