In every other state, a trust dispute that reaches court becomes a public record, which means the existence of the trust, its terms, and often its assets become discoverable by anyone who looks. For families where confidentiality is itself part of the objective, this is the strongest such provision in the United States. Privacy also has a protective function: assets that are hard to find are less likely to attract opportunistic litigation.
